What should we do if we have an employee refusing to wear a mask to work because it gives her anxiety? We are currently handling it as FMLA and allowing her to stay home. We are not paying her because from what I understand, healthcare workers are excluded from the paid sick leave act. Are we handling this correctly and how are other businesses dealing with issues like this?
For us, if someone refuses to wear a mask, we would send them home. However, if they had a note from their dr that stated they had a medical issue which would make it difficult for them to breathe, we would allow them to not wear it. They would have to still follow all the other CDC guidelines – 6ft, wash hands, etc. The CDC does address this in their FAQs. https://www.cdc.gov/coronavirus/2019-ncov/prevent-getting-sick/cloth-face-cover-faq.html
