    Have a new hire with us for 4 months. Noticed he disappeared 3-4 items a day for 30 minutes at a time. He has not requested accommodation under ADA for this. The doctor’s note he provide is brief and says only he is being treated for a condition that requires frequent bathroom breaks. Does this sound like something we have to accommodate? At some point this person will be driving a box truck 8 hours a day on a daily basis as an essential function of his position — so at that point not sure how we will be able to accommodate??

    Hi-
    It doesn’t matter that he didn’t request an accommodation at this point. You are obviously aware that he might be in need of one. Partner with your company attorney for the ADA questionnaire. You will want to get more specifics from the employee’s treating physician and will need to provide him with the specific expectations of the job. You’ll at least need to go through the interactive process before making a decicion.
